TREATY

on the Commission of the customs union

6 October 2007

The Republic of Belarus, the Republic of Kazakhstan and the Russian Federation, hereinafter referred to as the Parties,

based on the Treaty on the Establishment of the Eurasian Economic Community dated October 10, 2000,

Have agreed as follows:

Article 1

The Parties shall establish the Commission of the customs union (hereinafter referred to as the Commission) acting as a standing regulating body of the customs union.

The main task of the Commission is to provide the conditions for the customs union's operation and development.

Article 2

The Commission shall carry out its activities based on the following principles:

Voluntary stage-by-stage transfer of certain authorities from the Parties’ state bodies to the Commission;

Ensuring mutual benefit and compliance with national interests of the Parties;

Economically justified decisions;

Openness, publicity and objectivity.

Article 3

The Commission shall carry out its activities within the limits of its competence as envisaged by this Treaty and other international treaties signed by the Parties as well as the resolutions of the supreme body of the customs union.

 

Article 4

Each Party shall have one representative in the, this person being the deputy head of government or an accordingly authorized member of the cabinet. Representatives of the Parties shall work in the Commission on a permanent basis.

The Commission membership shall be approved by the supreme body of the customs union.

The number of the Parties’ representatives in the Commission and their status may be altered upon completion of the customs union establishment.

Article 5

The meetings of the Commission shall be held at least once a month. At the request of at least one representative of the Parties the Commission may be gathered for special meetings.

The Commission’s chairmanship shall be alternated in accordance with the order set by the supreme body of the customs union.

Rules and procedures of the Commission shall be approved by the supreme body of the customs union.

Article 6

The Commission shall carry out the following functions:

Execute the resolutions taken by the supreme body of the customs union;

Monitor implementation of the international treaties on establishment of the customs union;

Develop recommendations on the establishment and operation of the customs union for the supreme body of the customs union with the participation of the Parties’ national governments;

Within the limits of its competence ensure the implementation of international treaties constituting the contractual and legal framework of the customs union;

Render assistance to the Parties in settling disputes within the customs union prior to application to the Court of Justice of the Eurasian Economic Community;

Within the limits of its competence interact with the governmental bodies of the Parties;

Act as a depositary for the international treaties on establishment of the customs union.

The procedures and terms of the Commission’s operation in the specific spheres of its work shall be stipulated in separate international treaties signed by the Parties.

Article 7

The Commission, within the limits of its competence, shall adopt resolutions that have an obligatory nature for the Parties.

The Commission may adopt recommendations of a non-obligatory nature.

Votes in the Commission shall distributed between the Parties as follows:

The Republic of Belarus – 21.5;

The Republic of Kazakhstan – 21.5;

The Russian Federation – 57.

The decisions shall be taken by a majority of two thirds of the votes.

If one of the Parties does not agree with the Commission’s decision, the issue shall be brought forward for review by the supreme body of the customs union at the level of heads of state and the decision shall be taken by consensus.

The Commission shall also take decisions by consensus if it is envisaged by international treaties constituting the contractual and legal framework of the customs union.

Each Party shall be entitled to put forward a proposal to the supreme body of the customs union on a revision of the Commission’s decision.

If there are an insufficient number of votes during voting for the decision the Commission shall have the right to submit the issue for consideration of the supreme body of the customs union.

Article 8

The Commission’s decisions of obligatory nature shall come into force not earlier than one month after the date of their official publication.

Article 9

The Commission's activities shall be financed by the Parties in shared fees, proportionally to their number of votes in the Commission.

Article 10

The Commission may have its representative offices in the customs union member states.

The Commission shall have rights of a legal entity in the territories of all the Parties.

Article 11

The Commission's secretariat (hereinafter referred to as the Secretariat) shall be the Commission's executive body.

The Secretariat's functions and structure, number of staff and the status officials shall be determined by the international treaty signed by the Parties based on the Commission's functions.

The Secretariat shall carry out the organizational, informational and technical support of the Commission's work.

Article 12

The working language of the Commission shall be Russian.

Article 13

The seat of the Commission shall be in the city of Moscow.

The terms of presence of the Commission and its representative offices shall be defined by a separate treaty between the Commission and the state of presence.

Article 14

Exceptions from this Treaty shall not be admitted.

Article 15

Amendments and additions may be made to this Treaty in the form of a separate protocol.

Article 16

Any dispute between the Parties related to the interpretation and (or) application of this Treaty shall be resolved through consultations and negotiations between the interested Parties. If consent is not achieved the dispute shall be resolved at the Court of Justice of the Eurasian Economic Community.

Article 17

This Treaty shall be subject to ratification.

The procedure for entry into force of the Treaty, withdrawal and accession of the Parties shall be stipulated in the Protocol on the procedure of entry into force of international treaties aimed at establishing the contractual and legal framework of the customs union, accession to them and withdrawal from them, dated October 06, 2007.

Done in the city of Dushanbe on October 06, 2007 in one original in the Russian language.

The original of this Treaty shall be kept by the depositary, this function performed by the Integration Committee of the Eurasian Economic Community until it delegates these authorities to the Commission.

The Depositary shall forward a true copy of this Treaty to each Party.
