on cooperation of frontier guard agencies

of EurAsEC member states

in investigative activities

in the interests of external border protection

of EurAsEC member states

Article 1

The investigating activity in the interests of external border protection shall be performed in accordance with the legislation of the Parties.

Cooperation in investigating activities shall be organized for the most effective and mutually beneficial use of the means available in the area of combating the smuggling of narcotics, psychotropic substances, arms, ammunition, explosive, poisonous, radioactive substances and other goods and items prohibited for transit across the border and the prevention of illegal migration, as well as combating international organized crime, international terrorism and religious extremism, and carried out in accordance with the procedure established by this Protocol.

Article 2

Frontier guard agencies of the Parties shall cooperate in investigating activities as follows:

– fulfill requests for conducting investigating activities;

– develop and undertake joint or coordinated measures for preventing, uncovering and suppressing illegal activities on external borders, mutual notification on the results of such actions;

– take measures for the identification and examination of individuals preparing illegal acts at external borders;

– exchange experience in the area of investigating activities;

– additional elaboration of plans of joint operational procedures utilizing the potential of special task forces on tackling certain problems of mutual interest, dealing with transnational organized criminal groups, members of terrorist or extremist organizations, groups of individuals, and individuals.

Article 3

Exchange of information shall be carried out at meetings between representatives of frontier guard agencies of the Parties, as well as by mail, telephone, fax and other means of communication.

Each Party shall ensure confidentiality, the proper recording and storage of information and documents received from other Parties.

The provisions of this Article shall not be valid for the procedure of exchange of information of restricted dissemination or information that is regarded as a state secret or other secret protected by law, in accordance with the legislation of the Parties. Transfer of such information shall be carried out in accordance with the Agreement on information cooperation of the Eurasian Economic Community member states on border issues of 14 September, 2001.

Article 4

Requests for performance of investigating activities shall be submitted in written form.

In emergencies such requests may be communicated orally. Requests submitted orally shall be immediately confirmed in writing.

The requested Party shall in the shortest possible time inform the requesting Party about the results of the request fulfillment.

Article 5

For the purpose of settlement of current issues, coordination of ongoing activities, exchange of information, the Parties shall organize business meetings of representatives of the Parties’ frontier guard agencies. The dates of these meetings and the agendas shall be agreed in working order.

The results of these meetings if necessary shall be documented in Protocols.

Article 6

Business trips of representatives of the frontier guard agencies of the Parties to the territory of another Party shall be coordinated with the host Party.

Expenses related to the trips of the participants of working meetings shall be covered by the sending Party’s frontier guard agency.

Article 7

This protocol shall be an integral part of the Treaty on cooperation in protection of external borders of the member states of the Eurasian Economic Community and shall enter into force and be effective in accordance with the terms and in the order provided for by the Treaty.
